Huge Ballpark Success!

National Safety Consulting supplied onsite safety for the New Busch Stadium. While games continued throughout the regular season the Safety Temps provided safety consultation to the contactors and their subs successfully.
There had not been a single recordalble injury!

    THE ILLEGAL ALIENS AND IMMIGRATION BILL
    (House Bill 1549, Section 292.675)

    This section of the Illegal Aliens and Immigration Bill, 292.675, requires Public Funded Projects to enforce and monitor outside contractor and subcontractor employees insuring they have a valid OSHA 10 HOUR Construction Safety Training Card (or its equivalent).

    This procedure could become an administrative and investigative legal nightmare with costly overtones in training and monitoring man hours.

    The purpose of the Bill is simple
    It’s purpose is to keep illegal and alien workers off of publicly funded job sites. And to insure safety to those on these construction sites.

    You probably know that the bill passed last year with an overwhelming bi-partisan majority of both the House and Senate.

    Furthermore, Surveys indicate that HB 1549 is supported by 87% of the population of Missouri.

    Estimates are that there are between 60 and 80 thousand illegal aliens in Missouri at this time and that number continues to rise

    Chris Koster has been busy filling openings because much of the attorney general’s staff headed to the governor’s office.

    Missouri Attorney General Chris Koster’s sights are set. Less than three weeks into his term, health-care fraud, antitrust issues, mortgage and securities fraud, workers’ rights, and Internet crimes top his agenda.
    “At the heart of any attorney general’s office is the issue of consumer complaints and consumer protection,” Koster said during a wide-ranging interview with the Business Journal. “Attorney General (Jay) Nixon did an outstanding job in the areas of the ‘No Call’ list and the variety of consumer complaints that AGs’ offices traditionally work in. But the era is changing, and new issues are emerging.”
    Koster estimates fraudulent claims within Medicaid, for example, reach as high as 10 percent of the system’s payouts and could reach in the “hundreds of millions of dollars.” Koster said he hopes that by bringing more attention to the issue, he can encourage whistleblowers to provide information his office needs to go after scofflaws.
    Koster, who spent the past four years in the state senate following a decade as Cass County’s prosecuting attorney, authored an early version of an immigration bill that was ultimately passed by the General Assembly last year. The law penalizes employers who turn a blind eye toward the problem of undocumented workers. Now Koster is in a position to prosecute offenders.

    “If state government wants to create a jobs program that works and doesn’t cost a lot of money, enforcing the issue of undocumented workers on job sites is probably the best place to start,” Koster said.
    Before he can effectively take on such issues as the state’s top prosecutor, however, Koster must overcome some obstacles that come with a change in leadership. Many of the office’s top deputies and staff followed newly inaugurated Gov. Jay Nixon from the attorney general’s office to the governor’s administration.
    During the past several weeks, Koster has named appointees to many key posts.
    • Judge Joseph Dandurand of the Missouri Western District Court of Appeals is deputy attorney general. Dandurand was appointed to the court of appeals in 2007 by former Gov. Matt Blunt.
    • Ron Holliger, also a former judge in the Western District Court of Appeals, will serve as Koster’s general counsel and occupy the office in Jefferson City right next to Koster’s.
    • St. Louis lawyer Robert Kenney, formerly a partner with Polsinelli Shalton Flanigan Suelthaus PC and an assistant attorney general under Nixon, is Koster’s chief of staff.
    • Doug Ommen, who sits on the Missouri Administrative Hearing Commission and spent four years at the Missouri Department of Insurance, Finance and Professional Regulation, is chief counsel for the consumer protection division.
    • Page Bellamy, now chief counsel for the public safety division, had been the elected prosecutor in Lafayette County since 1994.
    • St. Louis attorney Joel Poole, who practiced product liability and commercial law at Holloran White & Schwartz LLP, was named chief counsel for the litigation division.
    • Former Assistant Attorney General Jack McManus, who joined the office in 2007 after serving 19 years in the Ohio attorney general’s office, serves as chief counsel of the agriculture and environment division.
    • Patricia Churchill, a Jefferson City lawyer with the firm of Gibbs, Pool and Turner PC, leads the governmental affairs division.
    • Dana Walker Tucker, who has been a partner with Fox Galvin in St. Louis since 2002, is now Koster’s chief counsel for the eastern region. She will manage the attorneys, investigators and support staff in the attorney general’s St. Louis office.
    Koster and his team are busy getting up to speed on tens of thousands of active case files inherited from their predecessors.
    Nixon is lending a helping hand in the transition. He hosted Koster for breakfast at the governor’s mansion Jan. 23, and they talked for an hour and a half about various issues related to state government and the attorney general’s office.
    “To get that kind of time from a new governor, is emblematic of the assistance he has given us,” Koster said. “There is no doubt he cares a great deal about this office and it being a success.”

    Koster also has several St. Louisans he leans on for advice, input and as sounding boards. Among his local confidants, he cites Tom Irwin, executive director of Civic Progress; John Sondag, AT&T Missouri’s vice president for external affairs; and developers Steve Stogel of DFC Group and Paul McKee, chairman and CEO of McEagle. And though Koster has spent the past 15 years living in the Kansas City area, he grew up in University City and maintains close personal and professional ties in St. Louis.
    “It’s important he understand that companies that have a lot of exposure may have more incidents of customer concerns, but what is important is how companies respond to those customers,” Sondag said of Koster. “The more communication he has with companies, the quicker some issues can be resolved, and his office will have more influence and be more effective.”

    U.S. Labor Department's OSHA cites Baton Rouge, La.-based employers $112,000 for alleged asbestos violations

    BATON ROUGE, La. -- The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) has cited Louisiana Health Care Consultants LLC, Dean Building Holdings and Bob Dean Enterprises Inc. jointly for three alleged willful and 10 alleged serious violations of federal health and safety regulations. Proposed penalties total $112,000.

    "These companies failed to follow OSHA's standards for asbestos-related projects in the construction industry," said Dean McDaniel, the agency's regional administrator in Dallas. "Employers must be committed to keeping the workplace safe and healthful to prevent injuries, illnesses and fatalities."

    U.S. Department of Labor's OSHA cites Huntsville, Ala., manufacturer for safety violations and $74,000 in penalties following fatality

    HUNTSVILLE, Ala. -- The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) has cited ATI Engineered Products for safety violations following a worker's fatal exposure to hydrogen sulfite last December.

    The agency is proposing a repeat violation with a $12,500 penalty after it found the process vessels not properly labeled. The company has been cited for a similar violation following a 2007 inspection at its sister plant in Gurley, Ala.

    The Huntsville, Ala., company is also being cited for 13 serious violations with proposed penalties of $61,500. Serious violations include failure to install hydrogen sulfite monitors and a lack of training for employees who handle hazardous chemicals which were related to the fatality. Additionally, deficiencies were found with regard to respiratory protection, confined space and lockout/tagout programs. A serious citation is issued when there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known.

    What do OSHA violations mean in “real money?”
    U.S. Labor Department’s OSHA proposes more than $255,000 in fines against New Hampshire firearms manufacturer for 60 safety and health hazards

    On June 11th 2009 OSHA proposed a $255,000 in fines against a New Hampshire firearms company.
    Sturm Ruger & Co. Inc. is one of the nation’s leading manufacturer of high-quality firearms for recreation and law enforcement, and a major producer of precision steel investment castings. OSHA conducted their inspections between November 2008 and May 2009.

    According to Rosemarie Ohar, OSHA’s area director in New Hampshire, “Our inspections identified a large number of mechanical, respirator protection, electrical, lead, fire, explosive and other hazards that must be effectively and continuously addressed to protect the workers at this plant from potentially deadly or disabling injuries and illnesses now and in the future,”

    OSHA found that the company failed to guard rotating parts on drill presses, sanding and polishing machines despite its knowledge that employees were exposed to severe or fatal injuries if they came in contact with the rotating parts. As a result, OSHA has issued the company one willful citation with $63,000 in proposed fines. OSHA defines a willful violation as one committed with plain indifference to or intentional disregard for employee safety and health.
